Governing the use of services and information provided by A.Q.C. Hydrotechnical Consultancy.
A.Q.C. provides hydrotechnical consultancy services related to industrial wastewater infrastructure and water resource management under the Canada Water Act. Services include engineering assessments, regulatory compliance reviews, and technical planning. All deliverables are provided on an as-requested basis and are subject to a signed service agreement.
No guarantee of specific regulatory outcomes is made. Clients retain responsibility for final operational decisions and permit applications.
Clients must provide accurate and complete information regarding their facilities, operations, and water usage. Failure to disclose material facts may affect the validity of any assessment or recommendation.
A.Q.C. shall not be liable for indirect, incidental, or consequential damages arising from the use of its services, including but not limited to regulatory penalties, production losses, or environmental remediation costs. Total liability is limited to the fees paid for the specific engagement giving rise to the claim.
This limitation does not apply in cases of gross negligence or willful misconduct by A.Q.C.
All reports, plans, models, and methodologies developed by A.Q.C. remain the intellectual property of A.Q.C. unless otherwise agreed in writing. Clients receive a non-exclusive license to use deliverables for their internal business purposes only.
Reproduction or distribution of deliverables to third parties without prior written consent is prohibited.
Either party may terminate an engagement with 30 days written notice. Upon termination, the client shall pay for all services rendered up to the effective date. A.Q.C. reserves the right to terminate immediately if a client fails to comply with these terms or applicable law.
A.Q.C. may update these terms at any time. Continued use of services after changes are posted constitutes acceptance of the revised terms. Clients will be notified of material changes via email or a notice on the website.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved through binding arbitration in Toronto, Ontario, unless otherwise agreed by the parties.
